1. Definitions
In these Terms and Conditions:
- “Heath Gym”, “we”, “our”, or “us” refers to Heath Gym, located at The Heath Business & Technical Park, Runcorn.
- “Member”, “you”, or “your” refers to any person using Heath Gym facilities or services.
- “Facilities” includes gym equipment, studios, classes, changing areas, football pitch, and any related services.
2. Membership
2.1 Membership is available subject to completion of registration and payment of applicable fees via Clubright website
2.2 Membership types and pricing may vary and are subject to change.
2.3 Membership is personal and non-transferable.
2.4 Members must provide accurate personal information and promptly update any changes.
2.5 Heath Gym reserves the right to refuse or terminate membership where a member breaches these Terms and Conditions.
3. Membership Payments
3.1 Membership fees must be paid in advance via approved payment methods.
3.2 Monthly memberships continue until cancelled by the member or the Heath Gym.
3.3 Failed or missed payments may result in suspension of membership.
3.4 Membership fees are non-refundable except where required by law.
3.5 Promotional offers may have additional conditions.
4. Cancellations
4.1 Members wishing to cancel recurring memberships must email gym@theheath.com to request a cancellation. Cancel at least 4 working days before the next payment date so the upcoming debit can be stopped.
4.2 No refunds will be provided for unused periods of membership except where legally required.
4.3 Heath Gym reserves the right to cancel memberships due to misconduct, abuse, safety concerns, or non-payment.
5. Health and Fitness Declaration
5.1 Members confirm they are physically fit to participate in exercise activities via a PARQ on the Clubright app or website.
5.2 Members with existing medical conditions, injuries, or health concerns should seek medical advice before using the facilities.
5.3 Members agree to immediately notify staff of any health condition that may affect safe participation.
5.4 Participation in exercise activities is at the member’s own risk.
6. Inductions and Training Guidance
6.1 New members may be offered an induction and introductory guidance on equipment use.
6.2 Members are responsible for using equipment correctly and following staff instructions.
6.3 Heath Gym reserves the right to restrict access to equipment if safe use requirements are not met.
7. Classes and Bookings
7.1 Group exercise classes are subject to availability and timetable changes.
7.2 Pre-booking may be required.
7.3 Failure to attend booked sessions without notice may affect future booking privileges.
7.4 Heath Gym may alter or cancel classes, instructors, or schedules at its discretion.
8. Teen Gym Memberships
8.1 Teen gym members can join if 13-15 years old and accompanied by an adult.
8.2 Teen gym members do not have access to classes or the weights room.
8.3 Teen gym members must show a form of Identification before their first visit.
8.4 Teen gym members must book in for an induction before they use any of the equipment.
9. Member Conduct
Members must:
- Behave respectfully toward staff and other members
- Use equipment appropriately
- Wipe down equipment after use
- Return equipment after use
- Wear suitable exercise clothing and footwear
- Follow staff instructions and safety notices
Members must not:
- Harass, intimidate, or abuse others
- Damage equipment or facilities
- Use facilities while under the influence of alcohol or drugs
- Bring dangerous or prohibited items into the facility
10. Personal Property
10.1 Members are responsible for their own belongings.
10.2 Heath Gym accepts no responsibility for loss, theft, or damage to personal property.
10.3 Lockers provided are for temporary use only.
10.4 Hired lockers are available and the Heath Gym accepts no responsibility for loss, theft, or damage to personal property
11. Safety and Liability
11.1 Members use facilities at their own risk.
11.2 Heath Gym accepts no liability for injury, illness, loss, or damage except where caused by negligence or where liability cannot legally be excluded.
11.3 Members agree to follow all health and safety instructions.
12. Photography and CCTV
12.1 CCTV may operate throughout the premises for security and safety purposes.
12.2 Photography or recording of other members without consent is prohibited.
13. Data Protection and Privacy
13.1 Heath Gym will collect and process personal information via Clubright in accordance with applicable data protection laws.
13.2 Personal data will be used for membership administration, communication, and service provision.
13.3 Heath Gym will not share personal information except where required by law or for operational purposes.
14. Changes to Terms
14.1 Heath Gym reserves the right to amend these Terms and Conditions.
14.2 Updated terms will be published and take effect from the stated effective date.
